I'd understand this if it was some gang shooting/drive by or something similar where witnesses weren't around or don't want to be found. This isn't a homicide or a high profile murder case. This was a hit and run involving an intoxicated motorist behind a 2 ton vehicle who luckily didn't kill any of the countless people she hit.

http://culvercity.patch.com/articles/dui-and-dwi-charges-filed-against-driver-involved-in-collision-with-cyclists
Los Angeles resident Christine Dahab will face felony charges on Dec. 22, stemming from a traffic collision that took place in Culver city in June that left 13 cyclists injured.
At approximately 1:40 a.m. on June 16, Dahab was driving in the 9200 block of Jefferson Blvd. when she struck and hit 13 cyclists.
The case was originally investigated by traffic investigators from the Culver City Police Department and was then submitted to the Los Angeles District Attorney's Office.
The DA's office charged Dahab on Nov. 11 with violating California Vehicle Code Section 23153 (A) [Driving Under the Influence of Alcohol causing injury], and California Vehicle Code Section 23153 (B) [Driving while Intoxicated above a .08 blood alcohol content, causing injury].
Both charges are felonies. Dahab wil be formally arraigned at the Los Angeles Airport Court on Dec. 22.

Christine Dahab was released just a short while ago after posting a bond on her 100k bail.
At the arraignment, her attorney entered a not guilty plea on her behalf and set a date of January 13, 2012 for a preliminary setting at 8:30am in Dept. 142.
When the issue of setting bail came up the defense attorney suggested that an amount between 50-60k would be fair considering a number of factors that he says showed that Dahab was not a danger to society nor a flight risk, such as: she has a 7 yr old daughter to care for, she has lived and worked on the westside of LA her whole life, the fact that the collision was the result of carelessness and not purposeful intent to harm, she has no prior convictions whatsoever, only had a .07 BAC, police reports indicate that perhaps cyclists were also at fault for being in the roadway and standing under a streetlight that was out.
After a sidebar with the Judge and attorneys, the prosecutor objected citing the numerous serious injuries, the fact that the .07 was recorded hours after the incident occurred and most likely was above the legal limit at the time.
Ultimately the judge agreed that bail needed to be set, but not at the amount suggested by defense counsel. So she set it at 100,000. Dahab was taken into custody at the end of the hearing. She had a group of five or six people there with her including what appeared to be a mother and a boyfriend.
I expect this case to drag out a while. I doubt she will agree to a plea bargain without letting her attorney look into all the investigation conducted by LAPD and CCPD.
That's all for now.

That's right. I forgot to include that in my update.
When the prosecutor objected to setting the bail so low he noted that the stage was set for something bad to happen even if there was no evidence of purposeful intent. He argued that there was certain danger to public based on the fact that her BAC was most likely much higher at the time of the collision, that there were empty bottles of smirnoff, jagermeister in the trunk and and prescription bottles for medical marijuana, some that still had marijuana in them.
He also noted that the cyclists were allowed to be in the roadway "as far as traffic" and if the situation was a dangerous one, then the motorist needs to be careful.

big questions:
why is she only getting charged with one felony? She hit 13 people.
if she had an open container and a marijuana prescription bottle in the car why wasnt that reported to the media rather than the condoms that were found on the hilltop by the LAPD?
last question, did they dna test the condoms?
I'm kidding about the last question.
Roadblock12.23.11 - 7:10 pm
reply
I'm pretty sure that she is NOT charged with only one. I was told it was two felonies by CCPD. I still haven't seen the docket because the court's system was not updated before the arraignment. So I can't confirm that it's only two either. Let you know what the docket says next week when courts reopen after xmas.
I chose not to speak to the DA the day of the arraignment because he wasn't the filing deputy and is really just handed the case that morning for arraignment purposes only. He won't be the one assigned to it Now that Dahab has pleaded not guilty and there will be some pretrial preparation, a new DA will be assigned to it.
Once I find out who that is, I will pose the question to them.
Even if she hit 13 people, you don't get 13 felonies unless 13 people reported they had injuries. Pretty sure the DA read off the injuries for at least 4 separate people, so there should be at least 4 counts of CVC 23153.

Lisa Houle is the deputy DA specially assigned to this case. I contacted her this week regarding the number of charges Dahab is facing.
Here is what she said:
"All the other victims were added as additional allegations to the two main counts for their individual injuries. This adds up to 3 years state prison for each individual victim. "
Today's hearing, a preliminary setting, will not be very interesting. Most likely it will be quick and they will just continue the setting hearing to another date. It would be great if people continue to go and observe though so Defense and DA take notice that the public is taking the case seriously.

I don't know what's going on with the DA's office but they're dragging their feet. A good friend of mine was almost killed two days before Dahab hit all those riders, in a hit-and-run, the woman turned herself in the next day... The lawyer does not know if the DA will press charges in his case, with over 1.8 mil in hospital bills... I wouldn't be surprised if the DA doesn't charge in Dahab case as well. If it doesn't make the city money somehow, I think it's a bit of a farce... Put some pressure on the DA's office!

This case is moving pretty slowly.
After the Judge at the LAX courthouse held on 7/12/12 that there was enough evidence to hold her to answer in felony court in front of a jury, felony arraignment was scheduled for 7/26/12 at the Downtown Criminal Courthouse for which Dahab did not appear. Don't know what the reason was.
She was finally arraigned at felony trial court in Downtown in August I think. There was a pretrial hearing on 9/21/12, and there is another pretrial hearing scheduled for 10/22/12 in Dept. 118 in Downtown.

Spoke to the DA - Heather Steggell. She does not expect Dahab to take the offer proposed by the DA's office tomorrow. She can not disclose the exact terms of the offer to me, but noted that it does include time in state prison.
However, Dahab may still decide to plead no contest to the charges and ask the Judge for a better sentence. This is called an "open plea to the court." There's no guarantee the court will give her something better than what the DA's office has all ready offered, so she may not choose to do this either, which leaves her with only one other option, setting the case for trial and beating the charges.
So who knows what will happen tomorrow....stay tuned.

On Tuesday, April 2, 2013, Christine Dahab entered a plea of no contest to all counts. She has pled "open to the court," meaning she didn't bargain for a lesser sentence but rather will ask for leniency from the court based on a diagnostic evaluation to be completed by the Dept. of Corrections while she is in custody.
She will surrender directly at a CA State prison on April 22, 2013.
She will remain in custody for the 90 day evaluation period, a report will be prepared by the Dept. of Corrections and sent to the Judge in Dept. D with its recommendations for sentencing.
April 22 is also on calendar as a probation/sentencing hearing, but they will probably just select a date out past 90 days to receive the report.
Victims will be notified of the actual sentencing date so that they can give their victim impact statements in court to the Judge to take into consideration.
