6GYC11 Hit and Run
Thread started by
Roadblock at 05.19.09 - 2:15 am
Yep, I'm at county USC. Was heading N. On glendale blvd. Was in far right lane preparing for a change to left lane to make left at park. I looked back and saw a car approaching at extremely high speed. I aborted my lane transfer and the car swerved into my lane and rear ended me at about 45mph. I flew up onto hood and probably dented hood and windshield. Drive applied breaks and I flew off into the street in the right lane. My read wheel is taco-ed and rear of bike smashed.
I had a helmet on. I was solo. Rear light on. Reflectors on shoes and headlight on flash minewt night rider.
Dark grey sedan 4 door possibly nissan or? Modern car modern headlights.
I will find this mother fucker. I put that on wolfpack hustle.
reply
Dude.... so shitty.
I take it that 6GYC11 is the plate numbers of the car?
Find him. Catch him. Hang him by his vas deferens.

He was coming so fast... I mean... it might have been 45 or 50 who know maybe more because I panicked and had a split second decision to move to get right and get out of the motherfucker's way. He swerved right into me full steam I mean I didn't hear any breaks nothing until I was up on his hood and hopefully cracked his windshield. He braked and I ended up about 30 feet from my bike where I came to rest on my stomach. He drove around me and the bike kinda slow so I hope to fucking god I got his plates right.... my vision was blurry...
Big thanks to XLarge man you are a real angel dude. Thanks for picking me up and driving me home so late in the evening.... we really got something special here in this ridazz community. Fuck. I'm just sore as hell but luckily no broken bones. I know for a fact the hood is crumpled, I felt it.
I'm gonna do everything I can to get this bitch prosecuted.
Wow.
Be careful out there everyone. Be safe. You never know when its your time..... these ignorant careless fucking LA drivers just don't give a fuck about you.
Thanks wolfies for taking care of my bike. That's the last time I take a shortcut. :)
Yeah that's good news about the plate format. Looks like I got it at least partly right. I'm gonna be so pissed if nothing happens to this punk bitch. I'm fucking steaming mad right now. Can't sleep.

Lawyer up, bro.
When they track down this scumbag, you will need legal aide.
I was hit last December and chose to deal with the driver's insurance company on my own. Everything was cool until it came time to settle up.
Mercury Insurance started playing hard ball over the lunch money I asked for for "general damages" (pain & suffering).
I'm taking them to Small Claims Court now.
Start by contacting Happy. That sounds like a great connection.

street justice. i hope I'm wrong. Make an example out of it: sue the shit out of this guy, and get him behind bars.

Ugh..... can't sleep. I'm sore as fuck.... I was lucky I think because the hood scooped me from under my tall ass..... I remember the hood crumpling and it feeling cusiony.... maybe he had antiloc brakes because I did not hear any skidding. I'm going to go back to the scene and see if there's any evidence of skidding - later after I rest some more.
Yes I always wear a helmet when I ride on monday nights. I had a really strong tail light and my flashing minewt night rider 2 and I had reflectors on the back of my sidi shoes.... it still happened.
I think I'm just going to start wearing a helmet all the time. This shit was so random..... I remember it pretty clear. I got really really lucky. Thanks to the bike gods and the universe.

Shit man, just saw this! First, glad you're mostly OK, let me know if I can do anything.
That stretch of Glendale is right near my home and I make that left often coming home. Drivers basically use it as freeway and the sight lines are compromised because of the curvature and slight elevation change of the road. I've seen numerous accidents along there.
It's bad enough to hit someone due to driving drunk, careless, and at excessive speed, but hit & run is just inexcusable. Let's hope they can find this guy and throw the book at him.

What is up with this area is that it's used as a corridor in & out of downtown because it connects to the 2 Freeway terminus about a mile north on Glendale Blvd. If it isn't choked with commuter traffic, it's cars blasting along way in excess of the speed limit.
I've lived above this stretch of road for 17 years and have witnessed numerous car accidents and even a pedestrian fatality. Yes, where Roadblock was hit is less than a block from where the ghost bike was located.
There are plans afoot to re-do the 2 terminus and people have also started talking about making the whole Glendale corridor more neighborhood friendly, but knowing the way government works I wouldn't hold your breath.
In the meantime, exercise caution if you ride this street!

There was a witness last night who said she saw the driver and gave the cops a description, so that coupled with hopefully an accurate plate and boom, fingers crossed this guy gets caught...
Sorry for my angry words up there, I was so steamed up that someone could be that careless and ruthless. The law will run its course and hopefully this guy had insurance or something I can sue for in a civil suit. I'm hobbling around cause I'm sore as hell but again, I got lucky nothing broke.
Thanks everyone.
Wear your helmets, use bright bike lights in the daytime as well.... you need to be 100% and even then something like this can still happen and it won't change until there is paint on the streets and traffic is tamed... wow.

I think that streatch of 2nd/Glendale, from the 2nd. st. tunnel to Sunset, is one of the most traveled streets by bikes in the city. At least I always take that route when I'm in the area and I always see other bikes there.
Its a little tight along Echo Park Lake and the left onto Park can be tricky in traffic, but I have never felt in danger there. Now I'll always be extra vigilant when on that road.

Holy crap, I'm glad you're alright, relatively speaking, Roadblock. This is fucked, I hope you find the fucker and screw him over in court. The hit and run thing is really starting to sound epidemic in LA lately. I'm not sure we get it, but somehow we've got to make it a standard that hit and run drivers lose their license, period, end of story, those fuckers deserve to never drive again. With an impact at that speed, it's quite possible a cyclist could die, and he would have left you for dead. Rest up, and hope you heal quick.

Councilmember Garcetti,
I am writing to inform you that a member of your council district was the victim of a hit and run last night. Miraculously, he survived with very minor injuries.
Ironically, he was at the city council meeting, just yesterday morning advocating for the preservation of LADOT's bikeways program in this year's budget.
This is the 3rd such incident that I know of in that area (glendale between the 101 and Sunset) in the last few months including the fatal hit and run of Jesus Castillo last month.
I know there is little you can do about this specific incident, however I hope that awareness of this ongoing problem will lead you to push for improvements to Glendale blvd. that will reflect the needs of cyclists, pedestrians, and the safer movement of automobiles.
sincerely,

I just feel really sick to my stomach if I don't get justice. It means it will be the second time I've personally witnessed a hit and run and nothing could be done.
Essentially... our government is BROKE. the detectives are so backed up they can really only go after things if there is a death.

Roadblock,
In addition to filing the police report, file an accident report with the DMV, so you can get them to look into it as well / get the driver on record with the DMV as well as the police.
http://www.dmv.ca.gov/forms/sr/sr1.htm
Also, you can google "CA license plate search" and get a whole variety of services that will pull license plate info for you for a fee of $20-40.
Good luck finding this guy.

Apparently the license plate lookup websites are a scam, but the DMV will perform a search for you if you fill out the form below and send it in with a $5 fee.

Also, once you obtain counsel (lawyering up should be free for you as it's a slam-dunk contingency fee case once they find the car (assuming the driver is insured)), have them fill out this form to get the info (if they don't already know about this).

Roadblock, do not give up. If anything, try to find a cop that has access to license plate databases, maybe a friend of a friend or something. It shouldn't be that tough to search for different variations, just sit down w/ a couple of folks and put your minds together on what the missing digit could be.
I refuse to believe that a streamlined process to search for partial plates does not exist, it's 2009 for fuck's sake.
Also keep up your search for witnesses, putting up signs is a great idea. Some of the best leads I got on the BikeCar were from people in the neighborhood where it was spotted. I put in a few hours of personal time, but it paid off.
Cops are "too busy" w/ other shit nowadays, we have to become vigilantes more or less until the "economic problems" go away.

Fom the comment section of metroblog:
Some dude claims you can get your insurance company to represent you if you have "uninsured motorist"
"Wow lucky he survived to tell you the story.
As a side bar when it comes to medical bills since he was hit by a car, specifically a hit and run auto, if he has uninsured motorist coverage on his auto policy he should submit the claim to them. Before anyone balks when I was a claims manager my unit handled a couple hundred auto vs bicyclist where our insured was the bicyclist who was hit by a car that either fled, was uninsured or underinsured. In short use the coverage if its available to help with the bills."
trickmilla05.20.09 - 2:02 pm
reply
Sorry to hear about your hit and run, that sucks! Hope you heal up!
I just asked another rida who is an insurance claims adjuster about filing an uninsured motorist claim as suggested a few posts ago, she said that it depends on the wording of your policy, does the UMP cover both parties or only the uninsured motorist that you hit? She said that people have been covered when struck while getting in and out of a parked car, but it's iffy when you're not actually in a car. However, you wouldn't be considered an at fault party so it wouldn't be a strike against you in the eyes of your insurance company if they reject the claim, and if they did cover you, it would most likely only extend to bodily injury and not property damage.
nancine05.20.09 - 2:35 pm
reply
oh correction, just got a followup email on uninsured motorist insurance:
"There is a VERY good likelihood that his UMBI would cover bodily injury, both specific (medical bills, chiro bills, etc) and general (pain and suffering, lost wages), IF there is not an exclusion clause specifically excluding coverage under certain situations.
He would need to go through the exclusions in his policy to find out.
Filing a claim would also help.
Now…if he has UMPD coverage, it may cover his bicycle as well, unless there is a "covered vehicle" clause that specifically excludes his bike or any other non-motorized vehicles. "

Just got back from detectives office.... very nice guy. A much more friendly and hopeful encounter than over the phone....
I trash talk too much sometimes. The problem is that the cops just don't have the resources to dedicate out of hundreds of cases, to a cyclist who survived a hit and run. Had I been killed or paralyzed it would be a different story.
The case has a lot of potential to bring light though to a major flaw with the laws....
The guy who hit me was undoubtedly drunk. And the fact is that hit and run, is a far lesser crime than drunk driving hit. So that's why this scum of the earth took off and that's why 90% of other shitbags take off.
There needs to be a change in the law regarding hit and runs. It needs to carry even stiffer penalties than drunk driving, which is a hard thing to top..... I'm going to start a new discussion thread on it....

Honestly, I am now convinced that if I get back on a bike, I'm wearing a helmet. You can do everything right... I signaled, I had bright flashing lights, I was riding on the right.... and still, some DRUNK piece of shit for a human being will change your whole life situation. I'm so lucky to be alive. Not 100yards from my final resting point another human being on a bike died from another drunk piece of shit subhuman....
We need to do everthing we can to be prepared for the worst and that includes wearing helmets, using bright flashing light day and night and like I say on many rides when drivers are acting irrate or beligerent... GET THE PLATES.
When you get hit. Get the plates and do whatever you can to remember. Recite the plates over and over until you can write them down until you can twitter them text them to yourself, write it on paper, yell it out to people, write it on the concrete in blood as you die. Its the first most crucial clue in the case that unfolds ahead of you...... if you get them... trust that this ridazz family is too resourceful and loving to let these incidents go. The new paradygm is that for these kinds of incidents you have to do all the work for the detectives to (hopefully) get justice....

POLICE VEHICLES AND LIGHTS
EMERGENCY WARNING LIGHTS: Are they really protecting YOU and making the emergency scene safer or making YOUR vehicle a target?
An article by Retired NYSP EVOC Instructor Robert J. Faugh - (Present NYS BMP & US DOT EVOC Instructor ) This article updated 1-20-06
Since the early 1950s, when the Beacon Ray replaced the single flashing light, we have seen more and more lights added to our emergency vehicles. It was believed that if 35 watt bulbs were good then 100 watt must be better. If two lights made it safer then six must make it really safe. How about a million candlepower strobe system? We have reached the point where the warning lights are becoming the problem at emergency scenes and traffic stops, making the area less safe and actually causing accidents! More bright warning lights DO NOT make ANY scene safer!
Studies of warning lights by the California Highway Patrol (CHP), Illinois State Police (ISP), University of Minnesota, NY State Police, NYS DOT and the US DOT, within the last few years have addressed the following factors: light output, flash rate, color and reaction to light emitted. In 1999 a five-state federally funded study also addressed the problem of warning lights when parked next to the roadway. (Fire/police/EMS/DOT/Tow Trucks) They identified two major problems. First, No emergency responder sets traffic control or warnings the same at a scene. Secondly, the public has no idea what to do when confronted with numerous colors of lights on vehicles parked every which way in the highway!
Most state Vehicle and Traffic Law requires if the emergency vehicle is parked in violation of the normal parking laws some type of warning must be displayed from that vehicle. Minimal lighting would be legal.
Every emergency vehicle has more than enough warning lights and is equipped so that if it is the only vehicle parked at a scene, the warning light law is complied with. The problem is that when there are six or seven emergency vehicles at a scene. When all the warning lights are left on, the area actually becomes unsafe due to all of the blinding and distracting lights. When you set up a "carnival" too much attention will be drawn to it. Officer safety is also an issue. All the flashing lights can distract the officer and also blind the officer while attempting to observe what is going in a vehicle or on the scene. The flashing lights also blind other motorist who then cannot see the officer. More lights DO NOT make the scene safer!
What effect do the flashing lights have on a motorist who is stopped in front of the police vehicle with all the lights glaring into their vehicle as they sit there waiting for their ticket? The police vehicle sits there with the flashing headlights blinding on-coming traffic. Put yourself in that position for a second, don't you think the situation would be less tense and less stressful without the warning lights flashing into the violators car? These same cops sit behind a disabled vehicle with minimal rear lights on, forwards lights off, what is the difference?
The ISP & CHP Studies questioned the use of light bars on their police cars and the safety of the officers while engaged in their duties next to the roadway. The collision rate for emergency vehicles displaying lights while parked next to the highway were two and one-half times higher for the same 100,000 miles driven than for non-emergency vehicles. Illinois removed the light bars from 50% of their cars and their study showed the cars without the roof-mounted bars were involved in 65% fewer accidents both parked and moving.
Many highway patrols have numerous "slick top" vehicles with a flashing lights in the rear window and no roof mounted lights. Many departments are going to the "slick top" cars for added safety, better gas mileage and increased productivity (more tickets).
More and more "slick top" cars are being used in New York state by local police, (Greece & Webster PD) sheriffs (Monroe & Onondagua) and NYSP. Roof-mounted light bars have their place but in many cases are over used and do not obtain the required protection. They also give the officer operating the vehicle a false sense of security that the lights will somehow protect them both moving and parked, which is not true.
What about color? Red lights send a message, emergency, stop and also tend to draw persons to the area of the emergency. The psychological reaction to red is rage, anger and hostility. Red lights invoke erratic behavior from other motorists. You are being subjected to the red warning light effects also.
The knowledge of human perception calls into question the use of red warning lights when the vehicle is parked in or next to the highway. Instead of warning people away, the red emergency lights actually draw drivers towards the lights. This so-called moth effect refers to "a state of narrowed attention associated with excessive concentration on some object or task with the resulting in a loss of voluntary control over response." People drive where they look! Drugged, drunk, elderly and fatigued drivers will drive right into the rear of the vehicle in the road and drive off the road to hit the vehicle parked on the shoulder that is displaying the red warning lights. This happens more than we like to admit. How many close calls have you had?
Amber lights are legal on emergency vehicles. The amber light also sends a very specific message to those who view it: danger, caution & stay away. A driver who is drugged, drunk, elderly, tired, fatigued or confused will avoid the vehicle displaying the amber light. Amber also travels through fog, rain or snow much farther than red, blue or clear. In California ALL emergency vehicles must display at least one amber light to the rear. Federal ambulance specs required one amber light on the rear of all new ambulance. NFPA fire apparatus "blocking mode" status recommend AMBER lights. (Phoenix Az allows ONLY amber when parked) Why are fog lights amber? Why does the FAA require amber on airport vehicles? Why does DOT use amber?
The NY State Police conducted tests on the vehicles equipped with the "Street Hawk" light bar back in 1991. They now have an amber lens on the driver's side rear flashing light position in the bar. 15 to 20 Cars were struck while parked on the side of the road with only red lights on.
Other New York State agencies reported between 75 and 90 vehicle struck while parked NEXT TO the highway annually. After amber was installed, and the rotating red lights were shut off, Not one NYSP car was struck in three years while displaying the amber light with the rotating reds shut off! As time has moved along the troopers are again leaving the rotating reds on along with the amber and more cars are being struck! NYSP have equipped most of their cars that work the interstates with "arrow sticks" in the back window. The 2002 NYS State bid "Federal Vista" light bar has a built in arrow stick. It works more effectively when the red rotators are shut off by sending one message - caution, danger and stay away! Inside the trunk one light is now amber.
What is the answer? For parking situations we should limit the use of the warning lights. Amber is the color to use to warn traffic. Shut off the red, blue and clear lights. Use the "arrow stick" as it was designed to be used.
Warn only from the direction that the traffic is coming towards the scene. Another reason to limit the amount of warning lights at a scene is the effect is has on the crowd. It's a known fact that the red, blue & clear lights at a scene will draw and effect a crowd. Shut them off and many will walk away.
Park your vehicles in a safest position possible, which should be at a slight angle 50 to 100 feet back from the next vehicle. (V& T Stops, stop at least 30' back - you are a smaller target the further away you get from the violator). The parking of vehicles is a whole other article. Just turning the wheels will not do it. Equip the rear of your vehicles with at least one amber light to send that message caution, danger & stay away. Equip you vehicle with an "arrow stick". The arrow stick light is more effective when used without the rotating flashing red, blue or clear lights. The more your vehicle looks like a DOT, tow truck or utility truck the less chance you vehicle will be struck. Be careful how you use your headlights, spot lights and other flood lamps, shut off the flashing headlights. You may blind on-coming drivers and also people working on the scene including yourself. Make your emergency scene look like a "work zone" and you will have a lot less problems, "close calls" and accidents.
Officer Safety: The officer should have the option to approach the violator or suspects vehicle from the passengers side of the car. Many states promote this, Texas and Virginia are two that do. The officer has a better view of everything in the front seat, is a smaller target. The violator doesn't expect the officer to show up there and the officer is in a safer position if one of the drugged, drunk, tired, elderly or confused drivers runs into the officers car or the violators car.
Many Monroe Co. NY agencies use this limited light policy at scenes and especially on the Interstate highways. The Rush Fire Dept & Ambulance Service has been using this procedure for 15 years.
The vehicle closest to on-coming traffic stops several hundred feet prior to the scene, parks at an angle and displays only rear-facing lights, amber on the left and red on the right ("arrow stick" is used if equipped). Other responding emergency vehicles (fire/EMS/police) shut down their lights and park in a safe position. All vehicles are then protected by the larger 20 ton fire apparatus. They don't need ANY warning lights!
The results have been much more control over the traffic that is moving past the accident or situation and less confusion - they don't have the flashing lights to look at. The other lane keeps moving without the gapers block or "rubbernecking". The traffic slow to 40 MPH or so and keep on going. When distracting warning lights are shut down, it is much easier to see. They use this at EVERY call not just highway incidents. Everyone calms down when the majority of the warning lights are shut off! Anyone working near traffic should wear a bright (lime-yellow) with reflective white stripped vest.
NEVER TRUST THE PEOPLE APPROACHING A SCENE. OPERATE AS IF THEY ARE TRYING TO HIT YOUR VEHICLE AND RUN YOU OVER!

another problem is that when roadblock tried to move out of the way, the guy tried to swerve around him and ended up driving right into him. it is almost better in that situation to hold your line and expect the motorist to attempt to swerve around you.

well more technically speaking, I never made it out of my lane. he was approaching so fast that I aborted the idea of getting in to the guy's lane completely. I was looking back and he got swervy trying to predict if I was going to follow through on my left signal - rather than slow down he guessed that I would get in his lane and he continued at full speed into my lane. my reaction to his speeding was to not only abort changing lanes but to get the fuck over to the right to avoid being anywhere near his car as he seemed out of control. I was hit while in the middle of the right lane at full speed or damn near full speed. there was no skidding sound and I could see that he didnt even try to slow down when he plowed right into me. I was carried on the hood for probably 50 - 75 feet before he applied the brakes and threw me off the car where I landed about 40 feet beyond where my bicycle was thrown.

I've been hit twice. The first time by a piece of shit hit and Run driver and the second time the lady actually stopped. After the first Hit,I was really shook-en up hard. I woke up at Cedar-Sini with just flash back bits of recollection. My Lip and nose scared up mean. First thing I asked was weres my Bike and Luckly the EMT brought her along for the ride..(hehe) After two weeks of recovery I was still paranoid. It took time for me to ease in again, but all in all You will be back to Normal in no time. Just lose the IF word from your Vocab. Can you imagine if Mr Obama said "IF" no, right? It makes me 100x madder at that self-centered dickwad to think that even for a minute
the douchebag could make you consider not riding again.
That would fucking break my heart.
But yeah, We forget what a leap of faith it is to ride in the street.
After a driver breaks that trust, it can fuck with your head.
Most importantly, heal up proper.
Seriously, I've been talkin' to ridazz (including myself) that have had injuries that didn't heal up 100% correctly. I am still having minor shoulder pain 1 year after a fall that didn't seem very bad at the time.
Once you have a bead on this asshole's insurance co. feel free to get all the medical attention you need/ want. They are obligated by the law to pay an infinite amount of necessary medical bills. Seriously.
In the mean time those dirty Daylight Crawlerzz have be takin' over the sidewalks; it time we took them back!

Roadblock, call your insurance company. If you've got uninsured motorist insurance, that should cover your hospital/treatment/etc. bills, plus it adds some more folks that want to track this guy down, which could help.

if you think your insurance company has your best interest at heart, you're crazy wrong. He works on contingency so it doesnt cost you anything. At least get a consultation. Then everything gets paid for and all you have to worry about is getting better.

Absolutely unbelievable. I remember I read your post when this happened. I can't believe you actually found the perpetrator. This fucker, whoever it is deserves to rot in jail for a long long time.
It's really sickening that hitting someone, and then running-which to me kind of assumes guilt is treated so lightly in the eyes of the law. If you accidentally hit someone and stay at the scene, you are being a fine, upstanding citizen who made a mistake or had an accident..fine insurance will take care of it...
But running from the scene...that is downright cockroach behavior. This person deserves to be treated like a cockroach, even if it is someone 'well known within city circles'
Sorry for getting so emotional about it but this kind of stuff just makes my blood boil. Roadblock, I can't imagine what you must feel about this. I've never actually formally met you but still I wish you the best of luck with this case and hopefully either this person can be made an example of or this can lead to a long overdue change in the punishment for this offense

Well as long as it's not a circus and people are respectful, there's nothing really harmful about it.
I've said it before, there's no room for shenanigans in a courthouse. You have to be quiet and non disruptive, can't talk while court is in session, no cell phones, no cameras/video without the judge's permission, no communication with the witnesses or jurors.
Also, it's probably best to stay away from the defendant, if the person is actually not in custody and walking around in the hallways or out in the parking lot. Can't be following the person around and taking pictures, that should probably be left to the media who stick to the courthouse steps.
