I want to hear about this DUI on the bicycle story. This can happen to any of us who drink while riding. Please share your experience, so others may possibly avoid this headache in the future.

I've gotten out of this twice. The first time, by quick fancy acting. The 2nd time, the cop never saw me operate the bike, just sitting on it, and knew that I was under the influence, by my eyes being glazed, so I got off and walked it.

i was riding down in san diego with about 5 friends, not an organized ride and we were going from bar to bar drinking here and there, well we stopped at a liquor store to get some more beers had no open containers just bags of beer started pedaling back to my friends place when the cops pulled us over for suspicion of DUI.

3 of us were over the legal limit by blood test. not really much i can say I was drunk but sucks its the same penalties as driving a car drunk since a bike isnt qutie the hi speed weapon a car is...

cops let us lock up bikes before getting taken in but thats about it.

I keep extra lights, a reflective vest, and a helmet in my back pack. This way, when I am all liquored up I look like a bike rider out getting exercise at 4:00am. Basically I suit up to look the part of prim and proper. I never get bothered as a result. There are nights where it is just me and the cops on the road and they do not even look at me when they pass me.

Do you know what they where suspicious of? What gave you away?

As a cyclist, I can tell if someone is not able to stay straight, but I would think, anybody who doesn't ride wouldn't be able to see it.

I've seen my friends drunk and not staying straight, but its not that obvious, unless you know what it looks like.

I know, if you have a drivers license and you don't submit to a chemical analyzer test, your licenses get suspended for a year automatically, if you are driving or walking down the street or just sitting on the curb, you don't have to be driving.

Somethings I know that they look for right from the get go:

Eyes--glazed or bloodshot

breathe, speech,

this is the biggest, how you handle getting your id from your wallet.
if you can do this without having a hard time, I've heard (and it's hearsay) that will show that you are in good control, and may let you pass.

Those are the first things they look at, I hear the better you hold it together, the least likely they will go after you. If you show more sign of not being coordinated, the less likely they will let you go.

My first encounter mentioned above, I believe got me a pass, because of the way I handled my back pack and wallet.

All I know is that when I have had a buzz going and you've been seperated from the group because of a flat, and you're trying to catch up to find them... that buzz sure goes away quick.

I know who I am, and most of my friends know who I am.
So far, all of you who think you know who I am are very wrong. I am not that person. For a long time I had my picture up for everyone to see. I changed it because of all the silly childish behavior. I also pretty much quit involving myself with the drama on this board. So I guess you can keep guessing and maybe someday you will get it right. This is a great place for ride discussions and posts just like this one. So please stop making assumptions. I am not he or her. I am me and I have a pretty clever screen name. The The Bom Chicka Wah Wah Ride and all the rest have been fun so far. I think posts like this should be made more often!

This law fucking sucks....I've always wanted to start a movement to get it changed...but I'm not that motivated I guess.

You have to have a license to operate a motor vehicle but none required for operation of a bicycle therefore, it should not affect your dmv record. It seems so logical?

The only thing you should be charged with as a Drunkin cyclist is being drunk in public.

it's different in each state. I know Washington state you can ride your bike under the influence without prosecution. In New Hampshire, the legislators changed the law, when a few time convicted drunk driver, ended up with jail time when he got convicted for riding his bike under the influence. the legislators where outraged by the fact they felt the guy took a responsible path of taking a bicycle instead of his car, when he knew he was going to be intoxicated.

I can see both sides of this issue. That guys father in Brooklyn who went on the wrong road, would probably rather see his son who is dead now, be in the court system for riding under the influence instead of being dead. People can hurt themselves on bikes, being under the influence doesn't help either.

Do I like the law? NO, but there is a reason behind it. If I had the ability, would I change it. Of course. Who knows, maybe in the future I will be part of that change

its because bicycles are considered vehicles. thats why you get tickets for running reds and stop signs just like cars. drunk on a skateboard is drunk in public because skateboards are considered pedestrian.

Drama? nope, not me. I do not like the drama. I know sometimes people have a problem with some of the things I say when it is not in his or her favor. Everyone has a friend group on here it seems and every one seems to know each other quite well. I only go on some rides and add my two cents in once and a while on here when it's important. Like this post. Nobody has ever asked who I was. they just assume I am some one else. That is very sad. Just because you guys do that sort of thing to each other does not mean that every one else does.

What I heard one time from what some dude did is this. This dude refused to take the field sobriety test and accepted to be taken in for testing and if drunk, jailed. Booking he said takes awhile, so he did whatever he could to burn this alcohol off, breathing at higher rate, exercising in his cell. Anyways when it came time for him to submit for the test, he choose the urine test. He submits to the urine test. When he had to submit for the second test, he couldn't pee. The state needs two test for this to be a valid conviction. So the officer gives him 5 - 10 minutes in the cell and asks him to pee again. The guy couldn't. So at that point he had to submit to another test, and he chose the breath test. The guy ended up being barely below the legal limit, so they had to let him go. I don't know if the story is true or not, this is what I was told. Good luck in the future.

According California Vehicle Code, DUI on a bicycle is not the same as DUI in a car.

According to VC 21200.5 (http://www.1800duilaws.com/states/vc_21200.5.asp
) the maxiumum fine is $250, and there is no mention of suspension of license or jail time.

If you get a DUI driving a car the fine can be up to $1000, plus several days in jail and suspension of your license. So you get off much easier if your busted in a bicycle than in a car.

If you have a drivers license, wll it go on your driving record? And, will your car insurance rates go up?

I think the statement at the end is important. 'Violations of this section are subject to Section 13202.5.'

'13202.5. (a) For each conviction of a person for any offense specified in subdivision (d), committed while the person was under the age of 21 years, but 13 years of age or older, the court shall suspend the person's driving privilege for one year.'

The way I read it, if your 21 or older you pay a fine. If your 13 to 20 you get your driving privilege suspended for one year.

I'm not talking the time to find the exact law, but I have in the past looked it up and the way I read the law

is that the penalties for operating a bicycle while under the influence of mind altering substance is the same except the fine is $250 instead of $410.

Meaning driver license revoked for 120 day on a first offense, and all the dam classes, meetings and bullshit that goes along with it. If you don't have a driver license, the suspension goes into effect when applying for a drivers license, meaning if you don't have a DL and you go to get one and you had the conviction, you have to wait 120 days til it is granted.

I think that lots of cop may let it pass, if you act regretful about it, and ignorant of the law.

I'm putting this up for future reference regarding losing your drivers license, after being convicted for DUI on bicycle;

C.V.C
21200.5. Notwithstanding Section 21200, it is unlawful for any
person to ride a bicycle upon a highway while under the influence of an alcoholic beverage or any drug, or under the combined influence of an alcoholic beverage and any drug. Any person arrested for a violation of this section may request to have a chemical test made of the person's blood, breath, or urine for the purpose of determining the alcoholic or drug content of that person's blood pursuant to Section 23612, and, if so requested, the arresting officer shall have the test performed. A conviction of a violation of this section shall be punished by a fine of not more than two hundred fifty dollars ($250). Violations of this section are subject to Section 13202.5.

SECTION 13202.5 STATES:

13202.5. (a) For each conviction of a person for any offense
specified in subdivision (d), committed while the person was under
the age of 21 years, but 13 years of age or older, the court shall
suspend the person's driving privilege for one year. If the person
convicted does not yet have the privilege to drive, the court shall
order the department to delay issuing the privilege to drive for one
year subsequent to the time the person becomes legally eligible to
drive. However, if there is no further conviction for any offense
specified in subdivision (d) in a 12-month period after the
conviction, the court, upon petition of the person affected, may
modify the order imposing the delay of the privilege. For each
successive offense, the court shall suspend the person's driving
privilege for those possessing a license or delay the eligibility
for those not in possession of a license at the time of their
conviction for one additional year.


there is more to the law, but this is stating that if you are convicted of bicycle DUI, you will lose your driving license privileges or they will be delayed, if you don't posses a DL, in the future when applying for one.
