Jaz, that is me.
I got a ticket this morning on the ride.

Both of those are what I was cited for. Any help in fighting this would be awesome.

You seem pretty bummed about your ticket. Just look at it this way: if you average the cost out between all the times you have broken the law, its way less than 1 cent per infraction. Totally worth it.

If it makes you feel any better I have two tickets unpaid tickets I can't afford, my court date is thursday, and amex told me they're starting court proceedings with me. So it could be worse. I'd probably be a little more on edge if I weren't sick. C'est la vie. You will Persevere!

I am 5 for 5 beating traffic tickets (auto), 2 for 2 on the camera tickets (which of course doesn't relate).
The object is to postpone the process as long as possible and to give the cops as many opportunities to screw up as you can. Everything, except a final court appearance, if necessary, can be done online or on the phone. So, here is the system: The most important part is that you follow up and not be the one to miss a deadline.
First, a week before your trial date get an extension. This will put you back 3 months from the ticket date. Second, a week before your extended trial date request a Trial by Declaration. The court will send you the paperwork and give you a deadline. This will put you back about 5 months from the ticket date. Now. remember, a cop gets paid time and a half to go to court. He gets paid nothing to fill out his own Trial by Declaration. If he doesn't send his paperwork in, you win. I've won here about a third of the time. Your Trial by Declaration should be as thoroughly full of shit as you can write it.
Now, if you lose here they will send you a notice. When you get that note and if it says you lost, NEXT is request a TRIAL DE NOVO. This is a whole new trial in court that they will give you just for the asking. This will put you about 7 months from the date of the original citation. AND NO COP EVER SHOWED UP FOR THAT OLD OF A CITATION (3x). Good luck!
and by the way, to beat a camera ticket, respond to the letter and tell them that the driver is your brother or uncle. go to google images and look for a euro drivers license and make note of the number, and give them the name and address of your "uncle" who lives in milan, or hamburg, or wherever the fuck you want them to live. (worked 2x)

do what he says...i'm waiting to hear back a verdict on my written declaration submitted a month ago from a december 2007 ticket.
for future tickets my advice is (if you know 100% you are getting a ticket) to just keep quiet and don't say a word at the scene. the last thing you want is the cop to take notes on the ticket that you were a smart ass or jot down any comments you made. any notes of you being an asshole may motivate the cop to actually write out his declaration. no notes on the ticket may make his say "fuck it" and not take any action.

Thanks indigis, so far that has been the most thorough in responsiveness. I'll try as I can. I have one witness that can attest that I was not on the wrong side of the road. If anyone else witnessed this fact, please email me at experimentalthought@gmail.com . I'm looking for anymore witnesses so I can send in a small book sized amount of information.

Is the date on the ticket just an arraignment date, or is that the court date that I am supposed to file an extension before?

the date on the ticket is your court date and the date you need to get an extension by. I usually log in about a week beforehand and get the extension... which reminds me, what's the court date on my new ticket???

I just called the phone number, and they said I needed to do it by 10 days before the court date. Which offers me no amount of time to do it, as I hadn't thought of calling beforehand, and thus have 7 days till that date comes up. Oh well, Trial By Declaration here I come then. Going to the court house tomorrow to pick up the required papers.

you won't need to go to court or the court house. if i remember correctly, you can do it all online.

try to get an extension here online. the phone system may be different than the online version of processing a ticket. print out everything for back up.
if you are able to get the extension, you'll then follow the rules above from the repost for the declaration. here's the instructions and the form. it's totally easy.

Anyone have any examples of the writings for a trail by declaration? I'm going that route for one of my tickets. Would be great to see some examples of some good declarations.............. or not.
