hey all, I need to locate the photos on the site and who took them to send to this lawyer. help me out. I recognize Mr. ijunes face but where is that photo?

If your pic is used, you don't need to track down the person that took the pic. You just object to your image being used. That should be the end of it right there.
Also it would seem that if the film maker can't prove that the images are his, then it should be taken down immediately. They're kinda going about it backwards and milking this thing.

The burn barrel picture and the red tag of Midnight Ridazz are from my flickr account. They're tagged "Midnight Ridazz". I think they pulled them from there as I didn't upload them here. I'm thinking all of them were nicked from flickr?

Dont trip you have no reason to feel like an ass...
If Kuang Lee really cared, he would step up and fess up to BR about it (maybe he will).
This isnt BR fault really; its the film maker(s). Not to distract the thread, but have you asked Kuang Lee to just tell BR he doesnt have the rights? Maybe he can copy you on an email, or conference you in on a call. That might be an "easier" way to handle this... have you tried that route?
If he is not willing, then that says a good deal about the dude.

that does not jive with ANYTHING i've ever heard. i'd ignore that.
there are two issues occurring here. copyright infringement and trademark infringement.
on the copyright case, RB has no claims unless the photographs are specifically his. complaints need to be filed by the photographer specifically or by RB as the agent for the photographer. either way, as soon as the lawyer sees that the photos ARE NOT the property of the film maker and a complaint comes in from a reasonable claimant, that should be enough. if the photos were uploaded to MR with the permission of the photographer, then RB would be in his rights to make a claim of ownership.
on the trademark infringement case, this is a bit more touchy and i'm not totally clear. they did not use the skull logo so no foul there. RB should â„¢ that mark, however to protect it. as far as the vFAGenda.com (heh heh) using "midnight ridazz" I'm not totally sure if that constitutes abuse. Though something tells me a lawyer could craft something around that.
the fastest way to make something happen is on the photo copyright front. that is brain dead easy and is totally indefensible for them.

The certificate of ownership is bullshit.
1. Tell them to remove the name midnight Ridazz from the website.It's trademarked.
2. Looks like the pictures have been pilfered from Flickr. We've tracked down about a third of them. Many of them on Flickr are marked as "all rights reserved".

3. Model releases. None of the people on these pictures have given consent for their images to be used on the Banana Republic webshite. (iJunes, Sarah, Tarsis, Richie etc)
Do they want a bunch of people photographers, models to file suits against them? By definition the pages named "inspiration" is NOT original material.

You should have the film makers co-sign your complaint.... seriously if you cant get that to happen (if they are unwilling) then I have to honestly say, there is real reason to be extremely pissed at them (in person too).
Melissa Lee or Kuang Lee should step up to the plate and do whats right.

I don't know...I just got out of my very first copyright class so I really have no idea, but a certification of ownership sounds about right...I mean you should have to prove that the photos you claim to be yours ARE yours, you know? I could be wrong but that's just what it seems to me...
It may not be an actual document entitled "certification of copyright ownership" but maybe anything that proves the photos are YOUR original work. I mean it only makes sense that you would have to prove that in order to take any action.

So.... this would be considered to be used in a commercial purpose? In other words, the film maker is going to win some money... $2500. So if one's Creative Commons were to ask for Attribution (which there wasn't any) and Non-Commercial... they'd be violating at least both.... right?

these images were likely taken witha camera shooting in *.raw format of sorts--I believe possession of a *.raw file or simlar type is equated with possession of a negative, albeit digital, which would signify that you are the owner of the image--this is likely the "certification of copyright ownership"
my bet is that these filmmakers are merely complete amateurs (as the writing and film quality (lack thereof) suggests) otherwise there is no excuse for using those images without permission or due credit
a lot of film students don't get a whole lot of coursework that adequately addresses intellectual property/don't think about it
anyone who has ever actually worked in the industry on any aspect of production knows quite well how important intellectual property rights are and has some sense of what is/isn't appropriate

the certificate of proof sounds bullshit, as the orphan rights bill never went through [ that if a piece of artwork is found on the internet without a credit, it can be claimed by anyone. ] so im pretty sure if its your artwork.. its YOURS. if you can at least prove it by dates or something.

copyright is inherent from the moment a work is created. you press the shutter, you own the copyright.
BUT, there is a big difference between a registered copyright and an unregistered one. If you have registered your work (about $35) you get a certificate and you are entitled to statutory damages for any unauthorized use. I think these damages are usually about $150,000 plus legal fees.
If you have NOT registered your work, you still own the copyright, but you'll have to fight your ass off to prove that it's yours, and there's no guaranteed reward, and you'll have to pay your lawyer.
In this case, i don't think that the inspiration pieces were meant to be published. i think those were internal links and they should've been password protected. I can't imagine you would have a problem telling them to take it down. it's like telling someone their underwear is showing.
the real issue is any photos linked off the actual video page in the "more section" and the trademark infringement.
I would think a strongly written letter would be enough to get everything taken down, without any actual legal proceedings that require rounding up every individual photographer.

Just an overreaction. It was more of the use of the reference of Midnight Ridazz, which has been now removed that triggered the group. Roadblock had initially asked them not to post the name or refer to the ride. Which was ignored. The photos were just an excuse to get a response so they would change it. (for some)

I understand your point, I mean, years back I felt like I was exercising my freedom by donating my pixels to people (usually after a few drinks) and though it may seem generous, it really was just something I didnt want to take credit for, nor did I ever want to be credited for the work.
I guess were in that regard we're on the same page. But I must say, looking back, I really should have been paid for my work.
