3 foot law

An simple law that would make riding on the road much more comfortable. As I understand it california has been tossing such a law around in the legislature. I hoe we see this happen here soon...

Avid bicyclists will tell you that a nice, long ride is an invigorating experience. But sometimes it gets your heart pumping for all the wrong reasons.
"There's plenty of times when you feel like that car came within inches of you," said Jeff Provisor, who owns Carpentersville's Main Street Bicycles. "Thankfully, knock on wood, I've never come into contact with a car. Motorists feel like it's an entitlement thing, like, 'What are you doing in my lane?'"
To cut down on incidents like these, Illinois lawmakers passed a law this year that will take effect starting Tuesday. Senate Bill 80 provides that motorists must leave at least a three-foot cushion when passing bicyclists on the road...

Isn't this already the law here in CA? I seem to recall reading it somewhere in the VC.
In regards to this, there is something you can get for your bike. It's a orange flag that sticks out and makes the driver want to avoid the flag. I have an idea similar to this orange flag. I would use the orange flag and also some heavy weight or something that would cause damage to the car if it hits it. The only problem I haven't worked out is the possibility of the object hitting the rider on a ricochet or something.
The idea of taking a light out is too good to pass up on this idea though.
