Tomorrow morning, i go to court to fight 3 infractions from the March Crank Mob.
How?
After leaving the Costco parking lot, a group of about 50 left for 'Cinco de Mayo' for some eats. Being the large Party Time Vehicle, why not travel at a speed for fellow riders to grab on? 30 Bicycles skitching later, and cops swarm at Centinela and Washington. 5 cars with lights a'flaring pull 'The BOX' over.
The cop was obviously engulfed in adrenaline and was not cooperative. I had jsut registered and insured the vehicle the day before for CRANK MOB so i had the temp. reg. and ins. He said if it isn't the final reg. and ins. then it isn't valid. Everyone had to exit the vehicle where they were patted down. It was kinda funny how the line of people leaving the BOX started with normal clothes and got crazier and crazier with each person, finally ending with me in a dress.
The cop wanted to search the vehicle which i would have problem with, until he started looking into peoples personal items. I told him he's not allowed to do that when he threatened me with jail. He picked up a piece of wood and told me it was a billy club and if i wanted to stay away from jail i should shut up.
The main reason he stopped me was for the 30 bikers holding on. He gave me a speech ladeedah and finally handed me the ticket.
3 Infractions:
Expired Registration
No proof of Insurance
Unlawful riding and towing
This should be REAL F.U.N.!!!!

You didn't know how the bikers got on your RV. How can you control what a group of feral bikers decides to do? You were decidedly outnumbered, it sounds like. 30 bikers, and how many people in the RV? Not your fault.

the officers got to me just in time. did you see the graffiti those bikers were drawin all over my RV? god knows what it would look like if they took another 30 seconds to get to me.

You'll get off for the registration and insurance. And here is a draft of a your explanation for those darn bicyclists hanging on to the RV.

This was the MOB where I had to bail early to get Mr.Overtime home by 6AM.

Well, this is simple - are there any witnesses that overheard the cop make that billy club statement? I believe those would be called "character witnesses" and could at least make the cop look like a douchebag. Where/what time is this court date? We could come represent like we did for BogalooShrimp at his SM court date.

There are a few other things the cop said to me as well that i would consider boundary crossing but i just want out of the ticket(s). I don't remember if it is 8:30am or 1pm so i'm showing up early tomorrow to sort it out. Maybe if it's at 1 i'll a drink a beer an hour til the appearance lol. I bet that would go over well :D

Unlawful Riding and Towing:
21712. (a) A person driving a motor vehicle shall not knowingly permit a person to ride on a vehicle or upon a portion of a vehicle that is not designed or intended for the use of passengers.
(h) A person shall not knowingly drive a motor vehicle that is towing a person riding upon a motorcycle, motorized bicycle, bicycle, coaster, roller skates, sled, skis, or toy vehicle.

Those are the relevant paragraphs of the CVC code that you were cited for. Your main defense should be around "knowingly" towing the bikers. You, afterall, had no knowledge of the bicyclists who grabbed onto your car. It is a big van, afterall, and has limited visibility. You were simply leaving Costco after getting some gas. You did see a lot of bicyclists but HAD NO REASON TO ANTICIPATE that these hooligans would do anything out of the normal, such as, latch onto a moving vehicle.
Ask the cop:
1. What was the size of the van you were driving
2. Did he search your vehicle
3. Did you cooperate by letting him search you vehical
4. On a scale of 1 through 10, how convinced is he that you had total knowledge that bicyclists were touching your vehicle (less than 10, he admits that you may not have "knowingly" been towing. If 10, go at him for his psychic abilities.
Sum up your case, that you were not KNOWINGLY towing anyone and it was a complete surprise when it was pointed out by the cop. That under the statute, you are not guilty.

Ritchie, make sure if you present a defense to the judge, it is NOT comical or halfed baked. Present yourself well and respectful... remember no one bears more grudges than lonely courthouse judges!

The last violation has been moved to AUG 7th 8:30AM

i still had to pay the $168 fine and will get it back if found innocent.

I get there10 minutes early, FUCKING TRAFFIC.
Only had a 40 minute max meter available so i fill 'er up and go in to court. I find out that the list of people to appear is like 40 people and they do everything alphabetical. Great... With last name starting with a T i'll be here for ever and will get a ticket outside the courthouse for being IN court. So i ask to move my car. Come back 15 minutes later, and $1.00poorer in quarters, and right when i walk in, the sherrif lady asks if i'm "Mr. Thomassen". I, of course, reply, "Why, yes. I am."...She walks to the judge hands her a piece of paper which i'm sure had scribbled on it somewhere ("Do you know what time it is?...PARTY TIME") and the judge asks me to step forward. She then calls out, "Officer Lopez?....Officer Lopez? Since the officer did not show up, this case is dismissed. Your bail will be returned, have a nice day" VICTORY!! But fuck, i wanted that cop to be there to make him look like the ass he is. But hey, i'm still happy :D
