Depends on who is working there. They supposedly aren't allowed to serve the drive through if you aren't in a car. Stupid exclusive rules.

The reason most drive thru's will refuse service is
they have no way of identifying you on video.
apparently some drive thru's have been held up by people on bikes
at least this is what I have been told.

Ive gotten turned down by the drive thru guys every time except for once when I went through on my tallbike. Just dont ask ''do you serve bikes'' at the speaker, order as normal, and take your time riding up to the window. if they make your order before you pay theyll normally just make the sale so they dont have to chuck it.

funny you should mention Carl's Jr. That was exactly what i was in the mood for late at night, but i wanted to ride my bike. So i just rolled up the drive through order kiosk and nobody ever came on. So i just kept rolling up to the window and the dude said i'll take your order, just go wait over there on the lawn and i'll call when your order is ready.
He recognizes me now as i do this funny ritual every now and then.
THe Carl's jr. on Santa Monica and La Brea.

NICE! Good to know that that Carl's will do it...I know I had a discussion with the security guard at the In & Out on Santa Monica one night about getting in the Drive Thru line & they finally let me do it (the cars were less than happy tho')...

Jack In The Box explicitly has it stated on their building that they won't serve anyone not in a car, even if they're flashing a fat-wad of cash.
As good as .99cent tacos are with dipping sauce, I suspect many an employee there has been canned in the past for skirting that rule.

The only law I can think of relating to this is the CVC, which explicitly gives cyclists the same rights as vehicles... in other words, it is perfectly legal to ride your bike through a drive-through.
Unfortunately, restaurants maintain the right to refuse service to anyone. So as above: depends on the specific place, who's working there, etc...
