At least they actually charged arrested Valencia for murder and not some lesser charge.

Marco Antonio Valencia has a Trial Setting hearing this Tuesday, Sept. 29, 2009 at 8:30am at the North Valley Superior Court, Dept. C, 900 3rd Street, City of San Fernando.
He's still in custody at North County Correctional Facility in Castaic for mowing down a group of cyclists. His bail is set for over $1.3 million.
I can't make it out to this one, but if anybody in the valley is interested, there you go.

I called the court to see what happened.
Trial setting was continued to October 28, 2009.

So I went to the pretrial hearing for this case last week. Pretty crazy story.
Valencia is facing 12 felony charges and 1 misdemeanor, including 2nd degree murder, gross vehicular manslaughter while intoxicated, multiple hit and runs and a DUI.

Apparently there were also two off duty L.A. County sheriffs riding in the group he hit. Luckily there were witnesses following Valencia and calling the cops with the plate # prior to the collision. Too bad the cops didn't get there sooner to pull him over.
He has a hearing on Dec. 24 for his probation violations and they'll probably set a trial date at some point, but I don't see this one going in front of a jury. He's better off taking a deal from the D.A. for a long state prison term than letting a San Fernando judge sentence him to life.
Nonetheless, he's going to be locked up for a long time.

I got rear-ended on the freeway by an intoxicated driver, and the judge gave the guy 6 months of probation. Didn't even suspend his license. A girl involved in the accident was a collegiate swimmer at the time of the collision. She will never walk again. Imagine her reaction in the courtroom when that sentence was handed down.
I have little faith in our criminal justice system to punish these people properly.
