2nd Amendment in California

Friends:

I'm sure that you are aware that the US Supreme Court recently decided in the landmark Heller v. Washington DC case that the 2nd Amendment of the Bill of Rights, really means what it clearly says - that individual citizens have a fundamental right to keep and bear arms.

As a legal matter, that ruling is only binding on the federal government, and not YET directly binding upon the states and local governments.

According to current 14th Amendment legal theory, in order to be binding upon states and locals, the 2nd Amendment must be "incorporated" as an enumerated and fundamental right, into the 14th Amendment.

CA currently has an ongoing court case that should result in "incorporating" the
2nd Amendment for CA citizens.

AMAZINGLY, however, CA law enforcement bureaucrats who SWORE to Support and Defend the Constitution, are actively opposing the 2nd Amendment of the Bill of Rights in CA!

These 3 organizations are planning to send legal Amicus Briefs opposing the 2nd Amendment and the US Supreme Court's Decision:

California Peace Officers' Association - 916-263-0541 - cpoa@cpoa.org

California State Sheriffs' Association - 916-375-8000 - cssa@calsheriffs.org

California Police Chiefs' Association - 916-481-8000 - lmcgill@californiapolicechiefs.org

I'm hereby requesting that Chief ____ and/or the _____ Police Department:

1. send a letter to each of the 3 organizations stating opposition to the unAmerican Amicus Briefs and positions on the matter, and

2. Address the same letter to the Court:

U.S. Court of Appeals, 9th Circuit
RE: Nordyke v. King, No. 07-15763
95 Seventh Street
San Francisco, CA 94103

It may be helpful to pass this message along to individual police officers who may wish to contact the Court and organizations, in the event that the organizations do not speak for them on this matter.

Additionally - anyone can call or write these organizations to ask them why they implicitly support the murder of elected African American Judges and Sheriffs by mobs (see US. v. Cruikshank, and The Colfax Massacre) and inquire whether they understand their members' oaths to "support and defend the Constitution of the United States."

Finally, if any City / taxpayer money goes to these organizations for dues, etc in any form - it should be CUT OFF (recognizing that CA POA is a labor union).

Sometimes, its necessary to stand up for Freedom....

NOTE: OUT OF STATE SUPPORT IS ALSO WELCOME

I've been contemplating getting a trailer for my track bike so I can mount one of those bad boys along with a gunner. Any cars try to get crazy at crank mob...they'll be in huge trouble.

And as crazy as it sounds...it could be legal. A crew-served, semi-automatic MA DUECE is perfectly legal in California. Even a M1919 crew-served, Semi-Auto.

And since you would be open carrying the rifle unloaded on a vehicle...you aren't violating any laws. And when that reckless driver comes along...it'll look like a wacky scene out of Black Hawk Down.

Some Japanese tourists love visiting shooing ranges when they come to the USA. The idea about freely using a firearm it totally foreign to them. But then again, so is our record rate of gun violence.

I'm all for people being able to shoot squirrels with grandpa to cook up a nice stew. Or being able to hole up in you apartment with a shotgun when the big one hits. But do we really need a more liberalized gun policy?

How about the right to bare bikes?

I carry several unloaded semiautomatic rifles with me at all times. It works great. Whenever anyone mugs me, I ask them to step back several hundred feet while I remove my weapons and magazines from seperate locked boxes, and deactivate the trigger lock. I can usually get the front stand and scope dialed in by the time they are at a reasonable shooting range. I then fire off several warning shots, which never fails to discourage even the most polite of petty criminals. So far I've only hit a bystander once or twice, but it was a very crowded public place and there was a crosswind.

BTW, REI has a great sale on ortleib panniers right now if you need to carry extra ammo in the rain.

Unfortunately, the 2nd amendment has nothing to do with hunting. I support hunters and have hunted in the past. But it makes a weak argument when it comes to gun rights.

I got to see a kid with his brain matter and skull fragments pasted on a side walk once. He had no chance. He got rolled up on by gang members hitting him up for cash. He said no. They shot him in the face. When the ambulance picked him up, he had strong brain activity. I got the hold that perimeter for 11 hours until he died. If he would have had a gun, he could of defended himself. Instead, he had nothing but his bravery...and he died because of it. Stricter gun laws did not keep the guns out of the hands of the people who killed him.

Just like banning crack doesn't get rid of crackheads. Just like banning alcohol doesn't get rid of alcoholics. ETC...ETC...ETC...

Oh, don't get me wrong. I have a lot of other shit to worry about.

Last time I was chased by a reckless driver while on my way to work on the bike...all I could do was call the cops. No U-Lock, no safety in numbers, no pepper spray, no gun, and not to mention I used to work for the police department...so I already had one or two serious-as-shit death threats. And although I was an employee, it still took 4 mins for the Unit to roll up. I had no plate. Only a vehicle description. I pretty much had shit.

Not a situation I care to be in again. Some of you know how this feels. THIS IS SOMETHING I WORRY ABOUT. I enjoy riding my bicycle just as much as everyone else here.

I just read an article someone posted in here recently about a female cyclist who was shot for her bicycle in a bad neighborhood. Maybe here being armed would have made a difference.

And if I never get a CCW, then I guess one day I'm going to have to go the criminal route and carry without a permit.

I'D RATHER BE JUDGED BY 12 THAN CARRIED BY SIX.

How about just working harder to avoid conflict in the first place?

Illegally carrying a concealed firearm in CA gets very messy very quickly, and in the absence of witnesses, shooting at a car, even one driven by a roadrager, looks a lot more like murder or attempted murder than self-defense, not to mention the chances of hitting an innocent bystander while firing a gun at a moving car from a moving bicycle are pretty significant.

If you find yourself in situations where you'd feel more comfortable with a gun, the answer is to figure out what you need to do to avoid those situations, not to buy a gun.

Wow...you got that whole scenario from my post??? I don't remember anything about shooting at moving cars from a moving bicycle??? You have one hell of an imagination.

Avoid conflict? I never go looking for conflict. Sometimes an action on my part is not necessary to find myself in a conflict. Some people will fuck with you just for the sake of fucking with you. The only way you can try to avoid any type of conflict is by locking yourself in your closet and never going outside. Not to mention that not all conflicts end with someone getting capped.

And without a CCW, I probably would not carry a concealed weapon...just like I don't carry a concealed handgun now. I'd prefer to stay out of prison. But if one day I feel like it needs to be done...then I will carry...and face whatever consequences come my way.
