I Fought the Law and the ... law won
Just wanted to give you guy a heads up. Went to court to fight this red light ticket on a bike and lost. out of 24 ppl who were at the court today, only 2 cops showed up for court. Just my dumb fucking luck he actually showed up...
On the brighter side of things, chances are to what I witnessed today is that the pig wont show up if you fight it. I watched about 20 ppl walk out of court with their case dissmised. so dont be afraid and fight those unjust tickets. The judge actualy gave me 50% off my ticket for showing up. so if you decide to show up and fight, chances are better than just giving up ur hard earned money.....
if you show up possibly recieve up to 50% off, or if the cop doesnt show u get 100% off... better than just laying down and taking the fine...

Damn, I should have done that. I fought mine through Trial by Declaration (no court appearance required) and had to pay the whole stinkin' $446.

Police get overtime pay for showing up to court.
That's how they can get extra cash.

Did you get an extension? Does that mean you didn't do a Trial by Declaration? What about requesting a TRIAL DE NOVO? What about the point on your car insurance?
My court date is early April. Your judge sounds nice.

50 is better than paying the full amount ... it sucks you still have to pay ..

No I didn't do the trial by declaration.Yes, I used one extension. You can get two but u have to show up @ the court house to get it. I didn't I just wanted to get it out of the way! You can change ur trial date but you have to go to the court house 10 days prior. No, you don't get a point on ur drivers license, since ur not in a car...

you should always attempt the trial by declaration. if you lose, you can still get a court date to fight it....it's like a free chance with nothing to lose....the cops get overtime for court but not for filling out their trial by declaration...so there's a good chance the officer won't fill it out...if you lose the trial by dec....i'm not sure if you get to request the officer's declaration if he did one...also, i'm not even sure if the cop NEEDS to fill one out. Anyone know the answer to that question?
barleye02.25.10 - 4:51 pm

The cop has to fill out some form for the TBD, and apparently cops get in trouble with their superiors if they don't fill out the form so there is some (non-financial) incentive to do it.
Not sure you can get hold of the cop's side of the story though...

So in my nicest voice I said fuck the police, get to work and earn ur pay pigs.... so yes dingo I said fuck the police but not in court.

One thing to note here is that although you can get a court date even after a trial by declaration, if you go to court after losing a trail by declaration you are apparently not allowed to present new evidence or information that wasn't in written declaration. So if you go the written route, make sure you write everything down, adding new elements to the story only after you go to trial doesn't fly.
I also beat my one and only moving violation ticket ever by written declaration. At the end of my blog post I've also included the full written declaration I used to beat the ticket, which was a ticket for not riding to the right when I was making a left turn, obviously bogus.

man.. lucky you didn't get detained for 40 minutes cuffed in a dark alley with two cops threatening to beat your ass. that's been my experience in orange county... corona del mar BICYCLE cops (yes, they were on bicycles, no dashboard squad car cam to record their crooked shit).

I saw the piglet get into his squad car and follow me for 20 blocks! Just when I thought that asshole had left, I took a yellow light. That turned red half way through, to my dissapointment he was just hiding and waiting like a predator. He later told me he knew I would eventually take a light and all he had to do was wait. Fuck the police

May we please have a 'silent moment' for those people that showed up to court and lost a dismissed case because the cop showed up.
Must feel good to be one of those 20 something people going to court and getting their cases dismissed huh?
