#1 Does the photographer have the express written consent of the subjects in each and every photo? If not, he/she does not have the right to post those photos any where with any right to ownership over any of the content since he/she has no releases for any of the subjects or content. Some may argue that the right of media in public places has implied ownership when taking a photo in a public place, but it is NOT so without an expressed written disclaimer posted in at every entry way to the possible venue of where the subjects were captured in the artists media or that the person or persons featured is not a public figure or figures.

#2 If you post on photos on most any social networks, they already have expressed written consent that the subject matter posted will become public domain.

#3 NOW, in the digital age of photography, video, and all other media know to the World and Universe, taking a photo does not grant you the right of ownership of the content.

Get REAL, don't think that because you snap a blurry photo of some random content, you have the expressed permission of ownership of said content.

Sorry Marino, but just because you take a picture in a public place, does NOT mean you OWN any and all content of said picture.

Additionally, did you have a permit from the City of Los Angeles to take photos for use in commerical or entertainment purposes? Did you have the expressed written consent of the organizers of said event? Do you have a copyright disclaimer posted on any of said media?

Come on, get the fuck real, you are lucky that The FMLY even posted a response to your outrages bullshit rhetoric.

I have always respected Marino as an OG Midnight Rida, but these unfounded posting by him makes me put my head down and shake it side to side :(

Professional photogs use their imprint over or on the corner of their pics when they desire to assert their copyright. You NEVER catch them screaming for their rights after the fact (because THEIR industry would laugh them straight out the door).

Barring an imprint that, you have that wonderful bastion of free enterprise, the public domain... the digital ocean, in which Marino's photographs appear to be doing the backstroke... lol.

FMLY's response wasn't a guilty one, but a respectful one. Give THEM the credz they deserve.

Point 4: Is totally not the same as what happened here.

FMLY created, organized, and executed their event. Marino attended the FLMY event and took a few photos of the FMLY event. Does Marino even have the right to claim ownership of the photos since the event was created, organized, and put on by FMLY? (not to mention the people who are in the photos, do they have rights to their images?) If I go to hear you play music and then I record that music, do I have the right to claim ownership over the music I recorded and that you played?

This isn't a copyright issue, guys. It's a common courtesy issue. As in: it is common courtesy to ask before reposting photos taken by someone else in the same community as you.

Anyway, if you just ask the photographer to post them over here too, they probably will do so themselves. And that's a solution I like: polite AND lazy.

Exactly it's a matter of courtesy.
I don't want to get into the legalese, owner, releases, copyrights, right to photograph etc which is completely on my side if you bother to google "photographer rights". Here is a concise one.

The matter between FMLY and me has been resolved but for anyone else who still has questions...

I take pictures and post them on websites as a gift to the organizers and the participants all of whom I consider friends or at least keen spirits. FMLY has posted my pictures and videos on their own website before (with credit) and people I have photographed often use my pictures as their profile picture on FB and elsewhere.

These pictures were posted on Facebook where only my friends could see them. So they were taken by a friend who could have easily asked me; "Hey can you post these on MR as well?" It's not the same as some total stranger took them off the internet.

When you buy a 30pack of Tecate as a gift to bring and share at a party it's not cool if someone grabs it from your hands and shows up at the party with your gift beer before you do. Even if they are the host.

It's your beer even if it's meant to be given away for free to total strangers. You want people to see that you brought beer to share with them. Is that kinda self serving? Yes it is but it's also ridiculous to be criticized by people who never bought beer for anyone but themselves.

FMLY, i aways took pictures from others when it was a ride i put on and never asked permission, but sometimes thanked the photographer afterwards in a post or something. I always felt that if someone was posting pictures from one of my rides that they would want me to share them as well. guess i was wrong. sorry marino for any pictures i used without permission. and sorry in advance if i ever do it again.

XL, Hate to step into a verbal spat but since it is my area of expertise, every single thing you said in relation to photo rights is wrong.

1. You don't need any permission to publish a photo taken in public. Only for commercial use.
Is it legal to take photos without permission?

2. If you post a photo on a social networking site you still own the copyright, it doesn't become
Facebook's Intellectual Property FAQ

3. Yes making a photograph most certainly does grant you ownership to that image. I'm not going to link laws because of how obvious this should be.

4. Taking a picture of something does not give you ownership of that thing. This I agree with, If I take a picture of someone's sweet fixie whip I have no claim to that bicycle, however I do own the rights to use that photo non-commercially "and commercially depending on a few more circumstances"

5. You do not need a permit to use your camera in LA for non-commercial shoots. With a few exceptions including the use of heavy equipment.


6. The event took place on public property as such it falls under the same rules as number 1. As such FMLY would have no right or claims to the photos. Also those photographed have no rights to the image.
Copyright for the subject?

7. Copyright is created the moment the image comes into existence, whether or not it expressly states it on the image. It is the responsibility of the publisher to confirm the copyright status of the image in question. Ignorance is no defense in a copyright lawsuit.

The reason I just wasted a half hour of my time is not to disagree with your opinion but to make clear the law. It's just better if everyone knows what's up, which is why I attached links so everything I said can be verified.

As soon as you put an image on the internet you lose de facto control of it. Which is why from the tens of thousands of cycling and party images I've shot over the year's people have probably seen less than 200 of them.

That many will take the opportunity to talk mad shit for the sake of it whenever a complaint is raised no matter validity of that complaint?

I've always wanted to throw "The Photo Op ride" or Perhaps it would be called the Bikarazzi .... or maybe Cops and Soul Robbers who knows? but it is hard as fuck to take good pictures of people while riding a bike on a dark street. I always thought it would be nice if we could arrange some riding and some stops in places with great ariel vantage points and decent lighting to try and capture the massive spectacle that is Midnight Ridazz. Of course such a ride would include shortcuts for all those photographers who'd like to stop and take a picture with out getting dropped.
