Hit by Car

Hello, I have a few questions regarding me being hit by a car. The accident occurred yesterday evening in Little Tokyo. What I want to know is: 1. Do I need a police report. 2. What are my rights. Thank god my health is fine no bone damage, but did scare the shit out of me. My rear tire is bent. Please any info from you guys will be really appreciated.

Yes. As I understand it, if you are injured, The police need to take a report. Did you get the drivers info? Did police arrive at the scene? You may want to get a lawyer involved.

1. Do I need a police report. A: Always try to get a police report--for several reasons, documenting the incident and obtaining information, so LAPD can record it as a car-on-bike collision, etc. If there are personal injuries, it goes without saying. Your comment was unclear if you have PI or only property damage. If you (or anyone) only has property damage, LAPD is oftentimes reluctant to take police reports where there is only property damage. Try anyway. You may have to make several calls, speak to a watch commander, and you can also email Sgt. Krumer (LAPD Bike Task Force Liaison) for more information.
2. What are my rights. A: Not to be snarky, but many. It all depends on what you are looking do and what type of information you have (i.e., driver, vehicle, insurance, witness contact info., etc.) Get as much as you can from the driver at the scene--you are legally entitled to it at the scene of the incident. CVC 16025.
Take care of your health first--and seek medical treatment if there are any issues there. Some don't show up until a day or so later, so don't be surprised if you wake up with a bad back, neck, knees, etc.
