36 of some 50 cyclists were detained because the manager of the CVS at 14735 Ventura Blvd called in asserting shoplifting without a description of the suspect. 11 squad cars arrived and searched everyone without probable cause including cyclists who had not entered the store. Three cyclists were put into squad cars - HANDBONE, Bernie, and u-lye (?), presumably to be arrested, before subsequently being released. The whole incident lasted about an hour.

Stephen Box was instrumental in gaining the release of the three cyclists. He used the little known technique "yelling at the Watch Commander and arguing semantics with him". Only one other rider is known to have mastered this technique - PC. Reportedly though, Alex Thompson may be getting close. When a Santa Monica resident complained about AT's intent to urinate on his tree, and accused him of being a bad representative of "his group" (SMCM), AT berated him for "being to quick to draw stereotypes", "using rhetoric to keep his lawn dry", and "having a small sample size."

My citation's in a world of it's own, but perhaps the stops should be like some of the other rides and kept out of eye-line-of-sight of the stores.

It was 2 hours of bull shit. There were 18 cops their wasting both of our time.

Thank goodness Fuzz, Sheli and Yetiman did not get caught up in the mess. Thank you guys for calling the right people for help, as well as documenting it with photos and video.

Anyone else want to protest at the CVS? The parking lot can't be closed to us- it's also for Marie Calendar's and a couple other shops, not just CVS. I say we make fliers with last night's story and go hand them out to anyone walking into that CVS... let people know where they're shopping.

I think when the manager called the cops he made it seem like it was a HUGE deal, you could tell the guy was freaking out (not to mention he was super weird), he probably told them we were trying to be violent in some way. but to get that many cops out you have to make it seem like there is an epic problem going on. I have no idea what he was thinking.

The downside of not self-policing is that actual police will come out and do policing for you, with sub-optimal results.

This isn't the first time shoplifting has been an issue, and it probably won't be the last, unless it's made explicitly clear that stealing is not ok and riders are to call out any incidents of theft.

14 cop cars is a bit excessive, but it sounds like they made their point.

Don't threaten a boycott of CVS, that's just laughable. Like CVS is going to be upset that a group of cyclists known for violating open container laws / upsetting motorists / having shoplifters in their midst is going to choose to take their business elsewhere. A boycott by us would probably be a dream come true for CVS.

I'm still amazed that we could be deemed such a potential threat as to warrant 12 cop cars and person by person searching. No one mentioned that. Detaining is one thing - stupid - but it's just freaking ridiculous that searching the 37 of us even took place. I kept thinking, "I know there's some real shit going down somehwere...and they're getting away with it because we're being fucked with."

But don't hate on tall cans guys, he didn't cause the nonsense. It's a shame anyone has to be dumb enough to put us all in that position, because of guilt by assocation. Don't be stupid when you're riding w/ a bunch of people. If you're gonna do dumb shit, do it own your own time.

Fortunately, the ridiculousity maintained some level of humor, like when the cops asked me if I was part of a gang I couldn't help but laugh. Or when they asked what we were doing...

Exactly. That's why I want to get out there... I live literally down the street from that CVS, it's the nearest 24 hour place to my house. That's why I want to get over there and get my neighbors informed about what a douchebag the manager of the store is. If we spin it as him being anti-cyclist, the "politically active" soccer moms can be convinced to shop elsewhere. That's much more effective than having Ridazz from over the hill boycotting the store.

That was me on the phone with Fuzz last night. I'm no legal expert, but I'm pretty sure that you can't search 37 people without serious probable cause. Hence, those were probably illegal searches. Filing numerous complaints, and a lawsuit are both possibilities.

Like Fuzz said - write down what you remember. If you want to go an extra step and email me at alexcthompson@gmail.com I'm going to use what I can to pitch this to the same ACLU attorney who is involved with the SMCM stuff. At the least I can get a referral to an attorney who specializes in this sort of thing.

Also, +600,999,111 to what kryxtanicole wrote about TallCans. As someone who has had a ride he is closely associated with absolutely shat on by police, it's hard not to feel a little responsible. But, you're not. Especially in this case, when the police overreact dramatically to a hysterical store owner. TallCans, from what I've seen, is a smart and careful organizer. He got struck by lightning here = nothing you can do about it. Fuzz, Coe Coe Butta, Coe Coe Butta's sister, TinyCities, and TallCans all did a good thing by keeping a level head, documenting things as best they could, and being as diplomatic as possible with LAPD.

Everyone on these rides are good people. As a community, everyone is willing to share their beer, cigarettes, pot, whatever. We all go through hard times, unemployment, etc. If you need a job, ask around...everyone is willing to help you. If you are broke and need a beer, just say something...you will never be turned away.

But please don't steal from the businesses on our rides. It makes us as a community all look like criminals. We ride on the streets because it is our legal right, but when someone steals it crosses the line and makes us all look bad.

Roadblock said something once to the effect that we need to show compassion rather than hate. Though it is difficult, I will try and follow this. Please don't steal, we want you to be a part of our community, so help please us and we will help you.

I Think the cops were waiting and ready for a call from a store owner saying there are being over whelmed by bicyclist. Why I say this, is because I’ve been doing these rides for a few years now. At some of the ride stops there’s been some shoplifting and doors locked up. Other times when I’m inside, the cashier is calling the police and freaking out. It really hit home when I did the SFVCM and we stop bye Dales Jr. down the street from my apt. We just rolled up and the store owner would not let us in. I tried to talk to him but he wanted no part of us. I was mad and never want to go to his store again. Today after a mountain bike ride and after I rolled bye the store and saw the owner and wanted to talk to him about it. I been to his store many times and he’s always nice to me and asked me about my rides. But today he was not interested in talking. I’ve been upset and Thinking of what I’ve seen and heard of what has happen in the past with MR rides. Now seeing this post and how shoplifter has giving cyclist a bad reputation. Was he once a victim of a non responsible MR shoplifter, so should I really be upset with him or my fellow RIDAZZ ??? For all the guys who Host the rides, GOOD JOB and don’t let this discourage you. keep them partying on, ……LongLiveMidnightRidazz

ok, This sounds crazy, but Being in the store when the "stealing" took place, there were maybe 5 ridazz in the store, most people were still arriving when the first cop showed up, The manager flipped out on one dude who had a jacket tied around his shoulders bandoleer style telling him he had to "leave his bag" he walked up to us all confused and was like wtf? he hadnt even gone in to the store proper just to the line to talk to us. at this point I paid and walked out as the first cop was arriving, having to pee, I slipped away as the first cop left (the first time) from across the parking lot, I saw him get into the street, make an illegal U turn and come back, from there it just got crazy what with the illegal searching of 37 people based on the fact that they were riding bicycles (the manager, or whoever called the cops had NO DESCRIPTION of said supposed thief, and couldn't even provide a GENDER).
As far as I can tell, from being in the store than luckily gaining a vantage point and not being part of the lineup, there was NOTHING stolen. We weren't even a rowdy crowd, the ride was pretty chill.

Like I said before, as far as I know, there wasnt even any beer stolen. I was in the first group of people to reach the beer, then was back at the front of the store before any ridazz even left. The cop had already showed up at this point. Most of the ridazz in line weren't even buying beer, most people were buying some water and snacks, we had just had a beer stop maybe 10 minutes before, at the park.
Besides the fact, everyone who was searched was searched illegally. Cops can't just search you because SOMEONE (who lacks a description on top of that) MIGHT have done something. They also cannot search you if you refuse the search (which people did, the cops then searched them anyway).

On the illegal search thing, it's kind of a big deal, don't just let them get away with it, you have the law on YOUR side in that situation. Not just the law, but the CONSTITUTION... it's a little thing called the 4th amendment:
The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

yup. learn your rights, make the cops flustered, confuse them when you assert the law they're supposed to be following.
I did this on friday night when a cop tried to tell me my freak bike was illegal, he totally deflated when I quoted the law and the exact section of the CVC back at him. Knowing your rights is tantamount to expressing them. Learning them doesn't take too long, the ones you usually need are the cvc and the constitution. srsly.

Police can stop and search you if they have "probable cause".

If stopped / detained on a ride you can always ask the officer:
Why am I being stopped?
(If the stop is legit, be polite and as forgettable as possible and handle things at the backend.)
If the stop is BS ask the office:
Am I free to leave?
If not, or if he/she tries to search you, ask if they have probable cause or if you can refuse and leave pursuant to your 4th amendment right to be free from unreasonable search and seizure.
If they say they have probable cause, ask them what it is, and if they have probable cause to detain/search YOU individually.

Obviously, only do this if you can maintain your cool and stay very very calm, as getting arrested for interference with a police officer / disturbing the peace / any variety of other misdemeanors, is a total drag, even if you're in the right.

The best first step is to make sure you can maintain a basic level of "situational awareness" during rides. Know where you are, your bike is, your friends are, and where the cops are as much as possible, so that you can keep the first three away from the last.

this is what i thought these rides would be like when i went to my first one. instead, i found a drunken mob who's only goal was to commit some anarchy. ok. not everybody was drunk and i guess a little anarchy is fun sometimes. but still!!!!! we're making ourselves look bad. really bad. i constantly see the code of the ridazz broken and disregarded. why do we even have it if we won't respect it? i think our egos have become a little to big for our bicycles. let's remember why we're riding in the first place.

we are, in a big way, the new counter-culture of america. we choose to ride bikes in a society where people are addicted to cars and oil. and we love it. everyday more and more people are getting on a bike. clearly, what we've been doing has been working and has had a positive impact on people.... up until now.

because of the wrong choices of a few our entire culture of ridazz has been put in a very negative light. nobody really likes us very much anymore. we can't let this happen! we must show people that the actions of a few DO NOT represent the actions of the rest of us. we are NOT criminals and we need to show people this or else everything we stand for will go to shit!

i'm all for party rides but, maybe every once in a while we can do something a little more productive. let's show the community that we respect where we ride and want to be respected in return. how about a ride where every few miles, instead of stopping for beer, we stop and pick up trash out of the street and on sidewalks, around parks and other places. clean up the place. or some fundraising rides for non-profits around the area. let's help people and the community; that's how we'll gain the respect we deserve.

what we've created is an incredible thing. just the fact that we can come together and forget our differences for a kick ass bike ride is awesome! we need to keep that. what we stand for as a peaceful, unified group and as cyclists holds so much significance in the world today that we must stay strong. we have the power to open a lot of minds and to bring a lot of people together. we're not criminals and we need to show people that NOW! otherwise, nobody will give a shit about our fucking awesome spoke cards. the hippies fell; the ridazz will not!!!

the cops are on to us. period. from the east side to the west side, the cops have been giving us more shit on a consistent basis. fuzzbeast pointed out that he was there and that it's highly likely that no one even stole anything at the cvs. but the increase of heat from the cops is a consequence of us growing bigger and more noticeable as a group, and a consequence of stupid actions from the past [i HAVE personally seen someone shop-lift at a 7-11]. so the bottom line is that riders need to stay informed of their rights, and be smart about their actions [which contribute to the whole group], because basically at this point we are being targeted whether we're acting out or not.

Guess what? He's a cop. We can't overthrow cops. He said he "dropped it" and to take him to court if (the guy that got cuffed) wanted to. Yeah, it's bullshit, but what are you going to do?

Fuzzbeast was talking to me last night, while we did our traditional ride into the underground Ralphs parking lot at Vineland and Ventura, that these rides are happening every night. It use to be that it only happened on the weekends, but now it's every night! Every night of the week, somewhere in this car-centric city, there is a group of bicyclists taking over the streets.

This higher profile is good, when you realize that the awareness level has reached epic proportions. But it is also bad, since every Dick and Harriette in a car is out there calling the cops on their cellphone when we block the intersections, run red lights and ride at 20-25 mph while a line of cars follow slowly behind us.

Are the cops on to us? Damn straight. What do we do about it?

Of course cops don't like us, but they have more advantage while we're at stops vs. when we're riding.

Anyway, I wouldn't like to change subjects and go crazy on all sorts of matters, but I also think that the thread should let people know- the ones that think they were treated unfairly, ie: harassed, etc. that there are people researching the legalities. If not, then why get angry? Yeah the cops took an hour of our time, and yeah some of them can be assholes and try to belittle you, but two out of three of our riders who were cuffed and put in cars were released. Plus we were lucky the cops decided to be lazy and not try and give us tickets for not having lights (the ones that don't.) Yes, they're human, they're tired, why would they want to fuck with petty shit like cyclists? Oh well.

June '08 LACM's stop at the Ralphs (I believe) in the marina resulted in someone stealin some beer. The store owner came out and civilly talked to some riders at which time people spread teh word and searched for the stolen alcohol.

I don't know what happened in that situation, but I sure know that no cops came. Actually, now that I think about it, maybe one did.


Anyway, just saying this isn't teh first time.

Part of the problem is the ride is starting to attract younger people. Use to be a time when most people were of drinking age. Now a big percentage are minors and it is no secret that MR will provide anything they need to drink or smoke; part of this 'community' thing. Troubles me to see that someone got a curfew violation ticket, how young do you have to be to get one of those?

I'm all for having everyone come out on the MR rides but be more responsible when offering someone a drink or smoke. Someday a minor or even a juvenile will get hurt and the closest adult might be blamed, main reason I stay sober on these rides.

Point is we are giving an an impression that MR is a drunken party on wheels, that everyone has to have something. I know that it might be a stretch but has anyone considered that some of the stealing might be because someone cannot legally buy alcohol? Not saying that minors and juveniles are thieves but in a setting where drinking is the norm, how are you going to get your beer?

My question was sarcasm (somewhat)....The party ride scene is quite hypocritical. It's been said 100 times here how we break some of the most serious driving/riding (same alcohol laws) laws with riding drunk and open container then we cry out for justice when something happens to someone on a ride.

The ACLU may get involved....but nobody will step up and be honest about the drinking that goes on. I'll have a drink sometimes on stops, but I don't get drunk nor impaired.

a drunk/stoned rida will kill a driver one of these days avoiding some asshole swerving or just being a jerkoff.

The LAPD did.

I did not drink on the ride exept for 1 12 oz beer at the start and a Vitamin water which I have the receipt for.

I did not go into the store.

I did not want to get searched and info taken but I complied.

I did want the LAPD to find the person who stole the beer and cart them off in the squad car.

I did not want anyone else who got searched to be in trouble.

19, no id, no reciept for an ICE COLD BEER in his backpack.

The LAPD went into the store and came out with the manager, then pointed at the guy in the white shirt and jean shorts. They walked straight over to him and aggressively search and interviewed him.

The video shows 3 people being taken into custody. The video shows Syooma (HANDBONE) being released, as well as someone I believe to be U-ly being released, by process of elimination. Bernie, who I know only by reputation and his profile photo, is not shown being released, unless I blinked. Stephen Box says that the Watch Commander he spoke to on Sunday said that two arrests were made. One was released and the other was taken to the station and "processed". He knew nothing further.

The focus here should be on the gross violation of the civil rights of 37 people. You cannot hysterically call the police and get a response of 14 cars for an alleged misdemeanor, or the illegal search and detainment of 37 people. It's not just, it's not legal, and it should not happen.

Focusing on the alleged shoplifting is totally misplaced. Do you think this is justifiable - this kind of abuse of power? How will you feel when you're face down on the ground in plastic cuffs with your 100 closest friends because someone ran a red, graffitied a stop sign, or spat on the sidewalk?

LAPD is on notice with the federal government about this shit. We, the citizens of the City of LA, have a responsibility to hold their feet to the fire.

Turrican, no-one is justifying the alleged shoplifting. What is being said is that the self hatred that has been going on in this thread, the automatic assumption that, because someone stole someone before, someone was automatically stealing this time, well it may not be the thing that should be the primary focus of the discussion.
So the person arrested had a beer in their bag, it was cold, they also had a bag, and someone else may not have, I know I've put my beer in someone else's bag on a ride before because I didnt have one, and this usually occurred right outside the store where I bought it. I also probably didnt give them the receipt as it was probably in my wallet.
Sure there's a bit of dumbassery for not carrying ID and carrying alchohol, however, without a description, that person was searched illegally.
Saying the store manager was singling out the person who was arrested is also not entirely correct, the store owner was screaming at everyone, he shut down the store, ejected everyone who was inside, screamed at patrons before people left, screamed at people even before the cops showed up.
The cops were acting on a call that said "Someone is stealing something" that was the extent of their information, that had no description, no account of what was being stolen and could not even provide a gender for the thief, that to me doesnt sound like reasonable suspicion for ANY suspect, never mind reasonable suspicion to search 37 people, regardless of innocence. In this country you are innocent until proven guilty in a court of law, and without probable cause (i.e. matching a description other than being a person who has a mode of transportation) there is no justifiable cause to detain and search so many people.
Are you telling me that in a parking lot full of cars, if someone steals something the cops should round up the drivers/passengers of EVERY car, search them and proclaim one of them the thief?
The cops also searched people after they flat out stated that they did not consent to being searched (which is your RIGHT, you should NEVER consent to a search by a LEO, regardless of weather or not you have anything to hide), which is against the law. The egregious violations took place over some alleged MISDEMEANOR theft.
From what I have learned through this incident that area has only 9 cars on duty at night, so cops were being pulled from either other divisions or they were just waiting for something like this to happen. Other than in that parking lot, there were no other cops out on duty in the Van Nuys division for that entire span of time (nearly 2 hours), and from what I have gathered (and common sense tells me) that there were other things going on more important than the possibility of some beer having gone missing.

We can't influence the police through this forum, but we can have some influence (albeit marginal) on our fellow riders.

You want to work on changing the police attitude toward riders, make an appointment to talk to the precinct captain, send a letter or an e-mail to the precinct, or work with Alex T. on whatever he's up to regarding this.

You want to make your voice heard about the dumbfucks that keep screwing up the ride for everyone, how to make the rides better and safer and more enjoyable, and how to keep Midnight Ridazz a place for sustainable fun, then this is the place.

It's not hard to participate on these rides while staying sober and reasonably law abiding and still have a tremendous amount of fun.

Hey FUZZ, yes, a parking lot full of cars would ALSO provide justification. As a matter of fact I used to drive a 69 Buick and was part of a car club of classic / hot rod cars. Really We were young and stupid of course and some of us stole beer from a Ralphs when we arrived at their parking lot. Needless to say the cops were called and cornered us ALL and asked questions and searched our shit. It's a reason-able reaction. any "GROUP" WILL BE DETAINED for the criminal actions of a few until they find out who the crooks are. It happens all the time. Live in LA for 20-30 years and you will get it. EVEN IF it's a gross violation, it has been happening for so long that no court will care to hear it. I guarantee it.

1) We need to keep other ride participants from stealing by first trying to talk them out of it before they steal. If they continue anyway, they need to be called out immediately. I don't think I am alone here when I say that ANYONE WHO STEALS SHIT IS NOT WELCOME ON ANY RIDE.

2) We need to raise awareness of the constitutional rights among all regular riders so they can step up and be leaders in scenarios like this. Not everyone knows what their rights are, sadly. Not everyone knows how to stand up and talk to a massive police force, either. The more people who are able to do this effectively, the better.

I must say, I tried talking to the cops on Saturday, and the answer was, "Shut up and face the wall, or we can arrest you and take you in." They had some sort of counter to every argument I could come up with under pressure, and of course, 18 cops: 1 mouthy kid, I think I'd end up in that jail cell if they wanted me to. It wouldn't matter if it's retroactively illegal, they still can harass us in the moment even if we know our rights.

Actually, your rights when stopped are more like this:
You CAN refuse to be searched, unlike a car where there's some bullshit about licensing and stuff which makes refusing things like DUI tests and things not possible, on a bicycle there is no such requirement, you CAN refuse a search, if they then search you anyway, it is a DEFINITE violation of your 4th amendment rights, unless they have already arrested you.
DO NOT consent to a search, as a general rule. EVEN IF YOU HAVE NOTHING TO HIDE. Also, one person in a group consenting to a search does not allow them to search an entire group, they must receive consent from EACH INDIVIDUAL.
Beyond a name and address you do not need to provide any information to a cop or even talk to them, except under certain circumstances, one of which is if you are holding alcohol, due to age requirements they can require identification in such a circumstance to verify your age, however, if you do not consent to a search, they shouldn't find any anyway, otherwise you're probably getting a ticket (which still doesnt mean you have to let them search you) for an open container, or he alchohol is visible but closed. Otherwise you do not need to provide any hard identification.
They will threaten bullshit like arrest, it's how they react, however, if you are co-operative, but do not provide information, there is not much that can do LEGALLY (it doesnt mean they won't break laws).

I was told that i was told we were being detained as 'assistants to a crime' or some shit like that. When I said that it violated my 4th ammendment rights, the cops said that the above was probable cause. I tried to refuse giving information and searching, they threatened to cuff me and force the information out of me (taking thumbprints) and took my ID out of my bag anyways.

Now some people don't get it how brilliant this is.They are bored and starved for attention. They need that parental interference. You have the "bad" parents (the cops) who want to spank you and punish you and you have the "good" parents (the civil libetarian wannabes) who come to "protect" you from the "bad" parents.

I talked to Bernie that night while we were riding down Lankershim Blvd. He is trying to get a job, he is trying to finish college and he is trying to make his parents happy. I know some people talk shit about him here, but I actually talk to him in person at the rides. I have said this before, we all aren't perfect, but if someone is cool to me like Bernie is, then I will always have respect for him.

And just for the record, I would like to say that my thread was for the sole purpose of eliminating, or reducing the need for law-enforcement presence on the rides.

From Bernie's side of the story, it looks and sounds like this whole mess was simply a combination of a "misunderstanding", a "break-down in communications", and to a lesser extent, "wrong place/wrong time".

But, once again, if anyone thinks I was trying to start a witch-hunt myself, y'all got it all wrong.

Sure, illegal shit hurts us. So people should stop doing it, and should spread the word that we don't want it happening; however, there was a lot of conclusion jumping and blame and vitriol going on in this thread, much of it from people who were not there, and from people making assumptions about what happened, even before they knew all, or even any, of the facts, and that in itself hurts us too. It hurts us on a community level.
Sure there are people who don't like Bernie, as I am sure, even in this community, one can find someone who doesnt like just about every individual on these rides, myself included, however, that is no reason to jump to conclusions. Jumping to conclusions is what the manager of the CVS and the Cops did, and look what that caused. Throwing blame around is what causes lynch mobs to happen, and seriously, we dont need that attitude in this community. While we may have problems to work out, being divisive isn't how to solve them. Being constructive is.
Divisiveness doesnt help anyone. Even if that person has caused some division in the past, you know what, who cares, until the facts are in, it's better to try to help them, and support them, rather than pointing fingers. Who knows, they may actually need our help. All pointing fingers does is cause more division. Turn the other fucking cheek people. We are supposed to be a community, and that's really a rare thing in today's society.

Sounds like all the speculation and assumptions were actually TRUE, some one WAS trying to steal. Was s/he someone on the ride? or just some stranger? I wasn't there, and I sure wasn't going to chime in on this stupid, redundant thread - until I read those words. All this trouble started because someone tried to steal from the CVS, period. Whatever actions the cops & management took, even though it was illegal, stupid, and a waste of time and resources - was started because some idiot got caught stealing.

Stop stealing when you're on OUR rides, assholes.

While agree with your call for togetherness/community, I would like to caution everyone that you cannot use this spirit to hide any wrong doing, as it affects the whole group.

Aside from the lessons we learned about the 4th Amendment, illegal search and seizure, etc. It is important to note a more immediate and practical lesson. That is when you buy alcohol for a minor and the cops come, an adult will be blamed and possibly arrested.

I cannot blame minors from wanting to drink, we've all been there, but I question the judgement of an adult that promotes it. I've met Syoma and he is a very likable, charismatic young man. I can see how people can get swayed but the risks are not worth it.

No ride organizer is responsible for the individual actions of people who show up to that ride. We are each responsible for the things we each do.

It would be great if we could call shit out as we see it, before the police get involved. But it would be even better if we didn't have to.

Stealing has been a problem on MR for a while, not just form stores, but from each other too. Remember Syoma's bike(s), my bag, other stuff that has gone missing?
Unfortunately, in a group that is open to ANYONE, anyone can come along. In all reality, we are often a group of strangers who happen to be riding bikes together. This makes it really difficult for us to know who's doing what, etc.
I'm sorry Dennis, but that sort of "it was your watch" talk is the kind of divisive, finger pointing kind of talk I was talking about earlier. It's everyone's responsibility to watch out for themselves, and to make it known what is and isn't tolerated in the group, however it isn't everyone's responsibility to scrutinize every other person they come in contact with. Sure if you see something happening, say something, make it known that that sort of behavior isn't tolerated; however, saying it's someone's watch, or fault that someone else did something on a ride someone was on, well that really isn't the case.
